Islamabad High Court’s three judges’ transfer issue has been challenged in the Supreme Court. The Lahore High Court Bar Association filed a petition in the Supreme Court through Hamid Khan, stating that the judges’ transfer is against Article 2A. The petition claims that there is a lack of transparency in the judges’ transfer process, and the reasons behind the transfer have not been disclosed.
According to the petition, amending Article 184 clause 3 and Article 175 clause 2 through the 27th Constitutional Amendment is unconstitutional, and transferring the three judges of the Islamabad High Court to different high courts is also unconstitutional. The two members of the Judicial Commission of Pakistan (JCP) also attended the meeting at the Supreme Court.
The petition takes the stance that the Supreme Court’s jurisdiction cannot be given to the Federal Constitutional Court, as the judges’ transfer was made after amending Article 200 through the 27th Constitutional Amendment, and the Federal Constitutional Court came into existence under the 27th Constitutional Amendment, so it cannot hear the case.
The petition makes the Federation and the Judicial Commission parties, and the petition was filed in the Supreme Court under Article 183 clause 3.
