In a landmark decision, the Federal Constitutional Court of Pakistan has ruled that tribal chiefs are not entitled to verify identification cards and domicile certificates. The two-member bench, led by Justice Amir Farooq, issued a 12-page written ruling, stating that the issuance of identification cards and domicile certificates is a formal process governed by law, and only authorized officials have the authority to verify them.
The court made it clear that no tribal chief can be granted the power to verify documents outside the law, as the tribal system has been extinct since 1976 and has no legal status. The ruling further stated that the tribal system is merely a regional tradition that cannot be legally recognized.
The court dismissed the petition, declaring that the petitioner was not a party affected by the issue, making the appeal inadmissible. The Federal Constitutional Court also issued a detailed ruling on the Super Tax case, a 293-page document signed by Chief Justice Aminuddin Khan.
The court stated that the person affected by the lack of identification documents should directly approach the court, not a representative. Ghulam Ali, the petitioner, had claimed to be a leader of the Khroti tribe in Balochistan and that verifying documents for his tribe members was a challenge. Ali had appealed against a decision by the Balochistan High Court, which was rejected by the Federal Constitutional Court.
