The US Federal Appeals Court has ruled against the Trump administration’s immigration policy, which allowed the detention of most immigrants without bail. According to Arab media, the three-judge panel at the New York-based court unanimously stated that the government misinterpreted the 1996 Immigration Act, leading to the implementation of the policy.
Judge Joseph Bianco, in his remarks, said that the government’s misinterpretation of the law put immense pressure on the immigration system, leading to families being separated and social problems increasing. The Trump administration had announced a new visa restriction policy targeting foreign government officials responsible for illegal immigration into the US.
It is worth noting that the Trump administration had argued that the policy was in line with the law, but the court rejected it, stating that it was against the spirit, history, and purpose of the law. Under this policy, the US government had designated long-time foreign residents as “applicants for admission” and detained them without bail, thus denying them the right to be released on bond. The court clarified that in the past, such individuals, particularly those without a criminal record, were given the opportunity to be released on bond.
Experts believe that the court’s decision could benefit hundreds of thousands of people, although the case may now go to the Supreme Court due to conflicting judgments from other courts.
