Imran Khan’s Party Labels Recent Constitutional Tweaks as Unconstitutional
Islamabad: The Pakistan Tehreek-e-Insaf (PTI) has filed a petition in the Supreme Court challenging the 26th Constitutional Amendment, calling it ultra vires to the Constitution. This marks the 16th petition filed against the controversial amendment.
In October last year, Parliament passed constitutional changes, including granting the legislature the power to appoint the Chief Justice, setting the tenure for the position, and forming constitutional benches.
PTI contends that the amendment violates the Constitution’s core features, such as judicial independence, rule of law, federalism, separation of powers, parliamentary democracy, and fundamental rights.
The party also claimed that the amendment was passed through an unconstitutional process, citing the incomplete composition of Parliament and the coercion and undue influence exerted on its members.
The petition demands that the court declare the amendment and related actions, appointments, and decisions as unconstitutional and void. It also seeks to nullify the amendments to the Supreme Court (Practice and Procedure) Act, 2024, and the Supreme Court (Number of Judges) Act, 2024, calling them unlawful.
PTI has urged the court to restrain the reconstituted Judicial Commission of Pakistan from convening, making appointments, or exercising authority under the amendment.
