The Anti-Terrorism Court (ATC) in Rawalpindi has reserved its judgment on a bail application filed by Alima Khan, the sister of PTI Chairman Imran Khan, in a case related to the November 26 protests. The case was heard in court, and during the proceedings, Alima Khan’s lawyer, Faisal Malik, argued that his client had not committed any offense. He maintained that Alima Khan had only delivered a peaceful protest message, which is a democratic and constitutional right.
Faisal Malik argued that the charges against Alima Khan were based on the Anti-Terrorism Act of 1997, Section 6, which deals with terrorism and not peaceful protests. He claimed that the case was a political vendetta and that the prosecution had failed to prove any link between Alima Khan and the alleged terrorist activities.
Prosecutor Zahid Shah countered by stating that Alima Khan had been charged under five sections of the Anti-Terrorism Act, and that the charges were based on a fact-finding report. He claimed that the theory of control, which states that the organiser of a protest has control over the participants, was applicable in this case. However, Faisal Malik argued that the prosecution had failed to prove that Alima Khan had any control over the protesters.
Alima Khan, in a statement to the media, claimed that the case was an attempt to silence her and that the government was trying to suppress the voices of the people. She also claimed that the government had taken away the people’s right to protest and that the 26th Amendment to the Constitution had abolished the people’s right to govern themselves.
