The family of Dr. Talet Khan, a Houston pediatrician who was fatally stabbed at her Conroe apartment complex, has filed a lawsuit against the property management company, alleging inadequate security measures.
The lawsuit, filed by Houston attorneys Mo Aziz and Bilaal Badat, targets Knightvest Management, LLC, Knightvest, LLC, Massandra KV Regency, LLC, and Massandra KV Regency, LLC d/b/a Alys Luxury Living. It claims negligence on the part of the property management company in providing security.
Residents of the Alys Apartments, where Khan resided, expressed ongoing concerns about security at the complex. Some residents reported having moved out due to safety worries.
The lawsuit alleges that the property management company was aware of criminal activities both on and off the premises but failed to implement sufficient security measures. It also highlights issues such as access control, including instances where the gate to the complex was left open.
Attorney Mo Aziz stated that their investigation revealed negligence on the part of the property management company, prompting the filing of the lawsuit on behalf of Khan’s family.
However, analyzing the lease agreement from 2022 revealed clauses indicating that security measures were not guaranteed by the property management company. These clauses pose challenges for establishing liability.
Despite previous security measures, such as a manned security booth, the lease agreement does not obligate the property management company to maintain them presently. This complicates the case, although documented safety issues and repair needs could be used as evidence.
Ultimately, the lawsuit aims to address the tragedy of Khan’s death and seek justice for her family, while navigating the complexities of landlord-tenant law and contractual obligations.
