Afghanistan’s Taliban government has introduced a new penal code that allows domestic violence against women and children, as long as they do not suffer severe injuries.
According to foreign media reports, the new law, which has been ratified by Taliban Supreme Leader Hibatullah Akhundzada, permits husbands to physically punish their wives and children, but only if they do not suffer severe fractures or visible injuries. In case of severe injuries, the perpetrator can face a maximum of 15 days in jail.
Under the new law, Afghan women and refugees are at a higher risk: an American journal stated that a woman can only sue her husband for abuse if she can prove it in court, while wearing a full veil, and with her husband or a male guardian present in court. Additionally, if a married woman is caught meeting her relatives without her husband’s permission, she can face up to three months in prison.
The new code, which has 90 pages, has abolished the Elimination of Violence Against Women (EVAW) law, which was introduced in 2009 by the previous government, backed by the United States.
