Seoul: South Korea’s Constitutional Court will hold its first hearing on Friday regarding President Yoon Suk Yeol, who was impeached following his short-lived martial law decree on December 3.
Yoon’s powers are suspended, but he retains his office with immunity from most charges except for insurrection or treason. Acting President Han Duck-soo has assumed the role in the meantime.
The court has 180 days to decide whether to remove Yoon or restore his presidential powers. If Yoon is removed or resigns, a presidential election must be held within 60 days.
Yoon’s legal team has not yet been announced, but reports suggest former prosecutors and colleagues could assist him.
The court has to deliberate with at least six justices to oust Yoon, but with three vacancies, unanimity is needed from the remaining six justices.
In the previous case of former President Park Geun-hye’s impeachment, the court ruled unanimously to remove her despite ongoing political rallies for her support.
Legal experts believe the court may aim to rule before the expiration of terms for two justices in April.
