Pakistan Following a special meeting of the party’s political committee last night, it emerged on Monday that the PTI has officially announced its intention to join the Judicial Commission of Pakistan.
According to the brand-new Article 191A that was recently included in the 26th Constitutional Amendment, it is the responsibility of the JCP to nominate judges for constitutional benches in the Supreme Court and high courts.
The first clause says, There will be constitutional benches of the Supreme Court, which will be made up of Supreme Court judges for as long a term as the Judicial Commission of Pakistan may choose, provided that there will be an equal number of judges from each province on each bench.
According to a statement released by PTI early on Monday morning, the party decided to send a letter to National Assembly Speaker Ayaz Sadiq and nominate two members from each house of parliament for the JCP.
The statement noted that the 13-member commission’s responsibilities have grown. It further noticed that the legal commission will screen the exhibition of high court judges and set up their yearly execution reports.
According to the statement, “one-third of the members of the judicial commission may call a meeting.” The statement also stated that “the judicial commission is also empowered to suggest suitable names for high court judges.”
A simple majority of the commission’s thirteen members will make decisions.
The statement continued, noting that the JCP will be a long-term commission, adding, “According to Clause D, the absence of any member will not affect the validity of the decision of the commission, and despite the absence, the decision of the commission will be considered valid.”
According to the statement, “the role of two members of the opposition is of crucial importance in the decision-making of the commission.”
The proposal of the party to join the judicial commission was accepted unanimously. The decision made by the political committee will be approved by the core committee and party founder Imran Khan in its entirety.
After Imran approves the two names for the JCP, an official announcement will be made.
According to the statement, PTI reiterated its position on the 26th Constitutional Amendment during the meeting.
