The Supreme Court of Pakistan has issued a written judgment in a contempt of court case, invalidating the decisions of the Single and Divisional Benches of the Sindh High Court. The judgment, issued by Justice Muhammad Ali Mazhar, directs the High Court to restart proceedings in accordance with the law. According to the judgment, it is mandatory to hold an initial hearing before proceeding with the trial, and the accused must be given an opportunity to clear their name during the initial hearing.
The Supreme Court has ruled that the Single Bench had proceeded with the trial without holding an initial hearing, while the Divisional Bench had ignored the legal flaw and instead dismissed the appeal, directing the parties to return to the Single Bench. The Supreme Court has now deemed the actions of both benches to be a misinterpretation of the law.
