In a significant development, the Supreme Court of Pakistan has issued a notice to the Election Commission in the Toshakhana case. The three-member bench, led by Justice Haseem Khan, comprising Justice Salahuddin Pirzada and Justice Ashtiak Ibrahim, conducted the hearing. During the hearing, a peculiar situation arose in the courtroom, with Justice Haseem Khan advising the gathering to keep in mind that the next day was a fasting day and two Pathan judges were present.
Advocate Latif Khosa stated that the three-year sentence of the PTI founder in the Toshakhana case had been suspended, but the verdict had not been stayed. Justice Haseem Khan replied, “I don’t understand. After the sentence is suspended, the verdict is also supposed to be stayed. Please read the relevant judgment of the High Court.” Advocate Khosa read out the relevant paragraph from the Islamabad High Court’s judgment.
In response to the PTI founder’s plea, the Supreme Court has issued a written order, postponing the hearing indefinitely. The court has also issued a notice to the Election Commission. Justice Haseem Khan, with a hint of amusement, inquired, “Advocate Khosa, you have only requested the suspension of the sentence in the High Court, not the verdict. The court has granted the relief you requested. You are referring to a judgment of the Supreme Court of 2019. Please read paragraph 13 of that judgment. In that judgment, both the sentence and the verdict were stayed. You have brought the judgment against yourself. It seems your vision is weak. We were advising you to listen to the Election Commission. You have brought the judgment, and we will consider it. Let’s move on. We will understand it in our own way.”
Advocate Khosa stated that the PTI intra-party election was at stake, and Justice Haseem Khan replied, “We have a large, visible chairman of the PTI sitting before us.” The court has issued a notice to the Election Commission, and the hearing has been postponed indefinitely.
