Lahore High Court has directed the ex-husband to pay Rs 10 lakh as mahr to his first wife, who is seeking a settlement without her consent. Justice Abid Hussain Chaudhry issued an eight-page verdict on the request of Mohnaz Salim. The court has accepted the request of the applicant wife to pay the value of her jehiz, expenses, and mahr according to her value. The Lahore High Court has amended the trial court’s decision, stating that the husband is bound to pay the first wife the mahr amount immediately if he marries another woman without her consent. Islamabad Supreme Court of Pakistan had ruled that the husband is bound to pay the mahr amount to the first wife until the divorce becomes effective.
The court has ordered the husband to pay the wife Rs 15,000 monthly expenses and the value of her jehiz until the divorce takes effect. The verdict states that the legal provision is in place to protect the financial rights of women and prevent clandestine marriages. The case revolves around three points of contention – mahr amount, expenses, and jehiz value. The family court had ordered the husband to pay Rs 10.5 lakh, Rs 15,000 monthly expenses, and Rs 45,000 in installments for 45 days. The Lahore High Court stated that the family court had ordered the husband to pay Rs 10.5 lakh, which is the value of her jehiz. The parties had filed an appeal against the family court’s decision in the sessions court, and the trial court had partially accepted the husband’s appeal and declared the decision on mahr and expenses null and void.
The verdict states that the trial court had reduced the value of jehiz from Rs 10.5 lakh to Rs 4 lakh. Mohnaz had approached the Lahore High Court against the trial court’s decision, stating that the husband had married another woman without her consent and had also married a third woman. She stated that the husband had thrown her out of the house in three worn-out clothes. The family court stated that the husband had orally divorced her, and therefore, he was only bound to pay the expenses during the period of iddat. The court’s verdict states that the husband had claimed that the wife had forged her entry in the nikahnama to claim Rs 10 lakh as mahr. The husband stated that the wife had left the house of her own free will and was therefore not entitled to expenses.
The verdict states that the husband’s claim of having another wife is proven by the record. The husband had a moral obligation to disclose the fact of his second marriage at the time of nikah. There is no evidence that the wife had left the house due to her misconduct or disobedience. Separately, a medical panel has been formed to examine Pervez Musharraf, the former president of Pakistan. Dr. Amjad and Dr. Nadeem Qureshi are members of the medical panel. The medical panel will examine Musharraf and then decide on transferring him to a hospital. Opposition alliance, Tahreek-e-Insaf, has demanded that Musharraf be shifted to a hospital immediately for medical treatment. Alima Khan, Pervez Musharraf’s sister-in-law, has stated that the news of her brothers’ voices has brought immense joy to Musharraf.
Atta Tarar has stated that Musharraf is receiving better facilities in jail than an ordinary prisoner. He stated that the prisoners in jail do not have access to a treadmill or a bicycle for exercise.
Ali Amin Gandapur has stated that he did not need any security for his visit to the jail and that the chief executive of the province did not need any security either. He expressed concern that the chief executive of the province, who has been elected, is being provided with security.
Punjab Chief Minister Mian Shehbaz Sharif has thanked the government for introducing the Ramadan Nigahban A.T.M card. Salmam Akram Raja has stated that Musharraf is entitled to proper medical treatment and that there should be no delay.
