The Federal Constitutional Court has rejected a request to record a land transfer over 100 years old. According to the court’s decision, the applicants had first approached the official records in 2020, a century after the transfers took place. The court ruled that it is not possible to rectify the record by simply labeling it a minor error after a long period of time, as many new owners would have emerged over the past century, whose rights could be affected.
The court decision states that the revenue officer’s role is only to maintain the records, and they do not have the authority to decide on disputes related to land ownership. The decision further states that under the Punjab Land Revenue Act, revenue officials can only correct errors that are not contentious, while determining the original ownership of the land is the responsibility of the civil court, which requires evidence.
The applicants’ ancestors remained silent until 2020, despite the matter becoming complex and requiring evidence. The High Court is not competent to make a decision in such cases, which is the responsibility of the trial court. The Federal Constitutional Court upheld the decisions of the Lahore High Court and the Board of Revenue and dismissed the request.
The case pertained to lands whose transfers in 1907 and 1913 had not been implemented, and the transfers had been approved in favor of the ancestors of the applicants by a court decree over a century ago.
