The petition was submitted to the IHC by KP’s secretary of administration, who claimed that the CDA had failed to de-seal the KP House in violation of the court’s instructions despite the order issued on October 10.
The petition urged the IHC to institute contempt proceedings against CDA director Javed Firoz and the other involved officials because they were obligated to abide by court orders, and disobeying those orders constitutes contempt of court.
The CDA sealed the building after police raided KP House to arrest Chief Minister Ali Amin Gandapur, who had led a procession of PTI supporters from Peshawar to Islamabad to protest against proposed Constitutional amendments and the imprisonment of former prime minister Imran Khan. Provincial government claims building has not been opened despite IHC order.
On Monday, the KP House was sealed for alleged building violations by CDA Special Magistrate Sardar Asif and the building control teams supported by police. The building was sealed, according to the CDA, because of what it called “illegal construction.”
It stated that notices were served as well, but the KP House administration ignored them.
In opposition to the CDA’s action, KP’s secretary of administration filed a petition with the IHC.
As no valid notice was given to the petitioner prior to the action, IHC Chief Justice Aamer Farooq ruled on October 10 that the sealing was carried out without proper legal authority.
In a related development, the KP government has requested the release of provincial government employees who were detained during the D-Chowk protest.
Respondents in the petition included the Sangjani station house officer, deputy inspector general, senior superintendent of police, and inspector general of Islamabad Police.
It stated that the KP chief minister was participating in the peaceful protest and that government employees were carrying out their duties.
The petition also stated that the government employees, including those who were a part of the 1122 emergency response team, were arrested after official vehicles were seized by Islamabad police.
The appeal mentioned the court to suppress the FIR and requested the police to deliver them.
